You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the goods.
To exercise your right of withdrawal, you must inform us (Leo Efimow, Stauferweg 1B, 91555 Feuchtwangen, Germany, Email: leo@efimow.com) by means of a clear declaration (e.g., by post or email) of your decision.
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods.
You must send back the goods without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us.
You will have to bear the direct cost of returning the goods.
Tuning files we produce based on your uploaded original ECU read-out and your vehicle-specific configuration (vehicle model, engine, transmission flash, rev limiter, top-speed unlock, hardware extras, etc.) are clearly tailored to your personal requirements and are not supplied in pre-fabricated form. Pursuant to § 312g (2) No. 1 of the German Civil Code (BGB), no right of withdrawal exists for such tuning files.
Insofar as we supply pre-fabricated digital content (e.g. non-individualised software files), your right of withdrawal lapses under § 356 (5) BGB as soon as we have begun performance of the contract, provided that you have, during the ordering process, expressly consented to us beginning performance before the end of the withdrawal period, and have acknowledged that you thereby lose your right of withdrawal upon commencement of performance.
